What kinds of damages are available in a personal injury claim? If one is successful in his or her claim, you may be entitled to recover damages relating to medical bills, lost income, future medical bills and care, and other economic damages that are incurred. In addition, you may be able to recover non-economic damages. These include pain, suffering, disability, disfigurement and loss of consortium.
How long does it take to resolve a personal injury claim? The time it takes to settle your case depends on a number of factors. To start, your personal injury claim will be resolved in one of two ways: by settlement with the at-fault individual’s insurance company or by verdict rendered at trial.
If you have a strong case with significant damages, your claim could be resolved in days, weeks, or months. If your claim is worth equal to or more than the insured’s policy limits, it can settle quickly, as well.
However, if your case has weaknesses (i.e. questionable liability or questionable damages), it may take longer to settle your claim or it may be tried. If the case is tried before a judge, you can expect resolution in approximately 1.5 – 3 years depending on the complexity of the case.
Can I settle my claim on my own? Legally, there is nothing preventing an individual from attempting to settle his or her own claim or filing a lawsuit pro-se. But a famous lawyer who eventually became our 16th president once said “He who represents himself has a fool for a client.” Without the proper legal experience, training, and resources, you’ll be at the mercy of a giant insurance company whose main goal is to prevent you from getting the compensation you deserve at all costs. In order to receive fair compensation for any type of personal injury claim, you’ll need to 1) be able to investigate and gather crucial evidence; 2) understand the evidence and key legal issues required for your specific claim and what you will need to prove in order to recover compensation; 3) comply with all court rules and know who to take legal against in the form of a lawsuit and when, where and how to file the lawsuit and most importantly; 4) negotiate with the insurance company or convince a jury of that the other party was at-fault and how badly you were harmed.
How much will it cost me to hire a personal injury law firm? At Panio Law Offices, we work on a contingency fee basis meaning that if and only if we recover a settlement or verdict on your behalf do we take a fee. That fee is a percentage of your overall settlement. In most cases, we also cover all costs associated with litigating your claim and unlike most personal injury firms, we do not insist on recovering our costs in the event we lose your case.
